These Terms and Conditions ("Terms") govern your use of the Used 2 B Yours online auction platform ("the Platform"), operated by Used 2 B Yours Secondhand Goods & Auctioneers ("we", "us", "our").

By accessing or using the Platform, registering an account, or placing a bid, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Auction Policies, and any other policies referenced herein.

If you do not agree to these Terms, please do not use the Platform.

You must be at least 18 years of age and a South African citizen or permanent resident to register on the Platform.

You must provide a valid 13-digit South African ID number for identity verification purposes.

You must have the legal capacity to enter into binding contracts under South African law.

By registering, you confirm that all information provided is accurate, complete, and current.

Used 2 B Yours operates as an online auction platform for the sale of secondhand goods.

All items are listed exclusively by the Used 2 B Yours admin team. There are no third-party sellers on this platform.

All items are sold voetstoots (as-is, where-is), meaning they are sold in their current condition without warranty or guarantee unless otherwise stated.

Descriptions and photographs are provided in good faith as an indication of the item's condition but are not a guarantee.

A bid placed on the Platform constitutes a legally binding offer to purchase the item at the bid price.

Once placed, bids cannot be withdrawn, amended, or cancelled.

A binding contract of sale is formed when the auction closes and the winning bid meets or exceeds any reserve price.

The winning bidder is legally obligated to pay the full bid amount and collect the item as per the Auction Policies.

Failure to honour a winning bid may result in legal action, account suspension, and forfeiture of membership fees.

Used 2 B Yours shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

We are not liable for any loss or damage resulting from: technical failures, system outages, or errors affecting bidding or auctions; inaccuracies in item descriptions or photographs; actions or omissions of other users; or any matter beyond our reasonable control.

Our total liability to you for any claim shall not exceed the amount of your membership fee (R100).

This limitation applies to the fullest extent permitted by South African law, including the Consumer Protection Act 68 of 2008.

All content on the Platform, including text, graphics, logos, images, and software, is the property of Used 2 B Yours or its licensors and is protected by South African intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written consent.

The Used 2 B Yours name, logo, and branding are registered trademarks.

You are responsible for maintaining the confidentiality of your account credentials (email and password).

You are responsible for all activity that occurs under your account, including bids placed.

You must notify us immediately if you suspect any unauthorised access to or use of your account.

We reserve the right to suspend or terminate accounts that we believe have been compromised.

Used 2 B Yours is committed to protecting your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).

We collect and process the following personal information: full name, email address, phone number (optional), South African ID number, bidding history, and payment records.

Your personal information is collected for the following purposes: identity verification and fraud prevention; processing auction bids and transactions; communication regarding auctions, account status, and platform updates; compliance with legal obligations; and improving our services.

We will not sell, rent, or share your personal information with third parties, except: where required by law or legal process; to payment service providers (e.g., PayFast) for processing transactions; or to enforce our Terms and Conditions.

Your personal information is stored securely using industry-standard encryption and access controls.

You have the right to: access your personal information held by us; request correction of inaccurate information; request deletion of your personal information (subject to legal retention requirements); object to the processing of your personal information; and lodge a complaint with the Information Regulator.

To exercise any of these rights, please contact us via the Platform's admin messaging system or email.

We retain your personal information for as long as your account is active, and for a reasonable period thereafter as required by law (typically 5 years for financial records).

The Platform uses essential cookies to maintain your session and authentication state.

We do not use third-party advertising cookies or tracking pixels.

By using the Platform, you consent to the use of essential cookies as described.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.

Jurisdiction: Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement: These Terms, together with the Auction Policies, constitute the entire agreement between you and Used 2 B Yours regarding your use of the Platform.

Amendments: We reserve the right to amend these Terms at any time. Updated Terms will be posted on this page with the revision date. Continued use of the Platform after amendments constitutes acceptance of the revised Terms.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
